Cavan man who killed his wife at their family home is jailed for 12 years

Oliver Kierans, aged 57, from Drumbannon in Bailieborough, County Cavan, has been sentenced to twelve years imprisonment for the killing of his wife Patricia at their family home on 5 September 2013. The Central Criminal Court imposed concurrent sentences of nine years for manslaughter, eight years for unlawful possession of a sawn-off shotgun, and twelve years for possession with intent to endanger life. A jury returned majority verdicts finding Kierans guilty of manslaughter but not guilty of murder following a two-and-a-half-week trial. The court heard that the couple had been married thirty-three years before separating in spring 2013. On the day of the incident, Patricia sustained a fatal shotgun wound to the chest at close range, with State Pathologist Professor Marie Cassidy confirming the cause of death. During his evidence, Kierans claimed that Patricia's death was accidental and that she was shot when she attempted to stop him from using the firearm, which he stated he had shortened with the intention of taking his own life following his remaining child's emigration to Australia. The prosecution contended that he had deliberately created the circumstances of the incident and maintained he was motivated by anger. Following the shooting, Kierans attended The Square public house in Bailieborough, where he brandished the same weapon and was found by gardaí. A protracted incident ensued before he was arrested without further violence. Justice Aileen Donnelly noted that Kierans, who has no previous convictions, has since been sentenced accordingly. Victim impact statements from the Kierans children and wider family were presented to the court, describing Patricia as a devoted mother and relative. The conviction was upheld on appeal in 2019, with the Court of Appeal finding that the trial judge properly instructed the jury and that the sentence fell within the appropriate range.
