Man due to appeal drugs sentence seeks adjournment after judge tells counsel Court of Appeal has power to increase sentences

Outcome: He was sentenced to 10 years imprisonment with the final three suspended by Judge Thomas Teehan at Clonmel Circuit Criminal Court on October 18, 2013. Before proceedings began in the Court of Appeal today, Mr Justice George Birmingham told counsel for McCarthy, Martin O'Rourke SC, that the trial judge found there were no specific and exceptional circumstances relevant to McCarthy in the case but "still proceeded to impose an effective sentence of less than 10 years".; Counsel asked for an adjournment and the case was put back into the next list to fix dates.
