Man spared jail for second time over attack on garda, despite DPP appeal

Outcome: Mr Justice Mahon said the court was satisfied that the sentence imposed on McAuley was unduly lenient and significantly so. If a three year sentence had been imposed in the Circuit Court it would have been appropriate to then suspend a portion of it to reflect the mitigating factors such as the guilty plea, expressions of remorse and efforts to rehabilitate.
