PATRICK FITZGERALD, featured in RTÉ Prime Time’s shocking report about abuses in
Cherry Orchard Hospital, has contacted Local News to commend its follow-up coverage.
Mr Fitzgerald was “punished” by managers in the Sycamore unit for drawing attention
to issues concerning the care of his wife, Anne. Relations become so poisoned that
they now restrict his visit to 60 minutes a day. Before the row, he had been by his
wife’s side for six hours daily and more.
However, a Local News investigation of the legal issues involved revealed that the
ban on Mr Fitzgerald was almost certainly unconstitutional; and that his restricted
access was, in addition, in violation of the European Convention on Human Rights.
Interestingly, both Bunreacht na hÉireann and EU law speaks in similar
language on two key issues: freedom of assembly; and rights to family
life. Mr Fitzgerald is now considering the use of either, or both,
to ensure full access to his spouse. See the next Local News West.
